These Vegas Drivers Earn Partner Program Terms & Conditions (“Terms”) govern participation in the Vegas Drivers Earn referral and partner program (“Program”) and use of VegasDriversEarn.com.
The Program is operated by Nocturnal Tours, doing business as Vegas Drivers Earn (“Vegas Drivers Earn,” “Company,” “we,” “us,” or “our”).
By applying to participate in the Program, checking the box indicating acceptance of these Terms, using an assigned referral link or code, referring guests, or accepting commission payments, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1. Definitions
For purposes of these Terms:
Partner means an individual or business approved to participate in the Vegas Drivers Earn Program.
Referral Link or Code means the unique tracking link, referral code, promotional code, or other tracking method assigned or approved by Vegas Drivers Earn.
Eligible Booking means a booking for a product or experience designated by Vegas Drivers Earn as eligible for partner commission.
Qualifying Guest means a unique guest whose Eligible Booking is properly attributed to a Partner, paid for, and remains valid and paid after the scheduled experience date. Attendance is not required for Commission eligibility. A guest who does not attend or is a no-show remains a Qualifying Guest so long as the booking is not refunded, disputed, charged back, fraudulent, duplicated, or otherwise reversed or disqualified under these Terms.
Qualifying Private Group Booking means an Eligible Booking specifically designated by Vegas Drivers Earn as a private-group booking that is properly attributed to the Partner, fully paid, attended, and not refunded, charged back, disputed, fraudulent, or otherwise disqualified.
Commission means compensation earned by a Partner for a Qualifying Guest or Qualifying Private Group Booking under these Terms.
2. Program Eligibility and Approval
Participation in the Program is free unless Vegas Drivers Earn expressly states otherwise.
The Program may be available to rideshare drivers, Uber and Lyft drivers, taxi drivers, limousine drivers, black-car drivers, shuttle drivers, tour drivers, hospitality professionals, and other persons who regularly interact with Las Vegas visitors.
Partners must be at least 18 years old, legally capable of entering into a binding agreement, and provide accurate contact, payment, and tax information when requested.
Submission of an application does not guarantee acceptance. Vegas Drivers Earn may approve or reject a Program application in its reasonable discretion.
Partners are responsible for determining whether participation in the Program is permitted under any employer agreement, independent-contractor agreement, transportation-network agreement, professional licensing requirement, company policy, or other obligation applicable to them.
3. $50 Per Guest Commission
Unless a different commission rate has been expressly agreed to in writing, a Partner earns $50 for each Qualifying Guest properly attributed to that Partner.
There is no Program-imposed limit on the number of Qualifying Guests a Partner may refer or the amount of Commission a Partner may earn.
Examples displayed on the website or in promotional materials are illustrations of the standard $50-per-guest commission structure and are not guarantees of earnings.
A guest must satisfy all requirements of a Qualifying Guest before Commission is earned. Guest attendance is not required so long as the Eligible Booking remains paid and is not refunded, disputed, charged back, fraudulent, or otherwise reversed.
4. $1,000 Private Group Commission
A Partner earns a $1,000 Commission for each Private Group Booking, unless a different amount has been expressly agreed to in writing.
Private groups may include bachelor parties, bachelorette parties, birthday groups, wedding parties, corporate groups, convention groups, large friend groups, and similar private groups.
Private-group Commission is paid per Qualifying Private Group Booking, not per individual guest within that booking.
A booking may qualify for either the individual $50-per-guest Commission or the $1,000 private-group Commission, but not both.
5. Commission Rate at Time of Booking
The Commission rate applicable to a referral is the Commission rate in effect when the Eligible Booking is confirmed and properly attributed to the Partner.
A later change to the Program’s Commission structure will not reduce the Commission rate applicable to an Eligible Booking that was already confirmed and properly attributed before the change.
6. Referral Tracking and Attribution
Partners are responsible for providing guests with their assigned or approved Referral Link or Code.
Vegas Drivers Earn will use its booking records, referral tracking records, timestamps, promotional codes, communications, and other reasonably available information to determine referral attribution.
Commission may be denied when a Referral Link or Code was not properly used and Vegas Drivers Earn cannot reasonably verify that the Partner originated the referral.
A Partner may not knowingly claim a customer, guest, or booking that was independently acquired, previously referred by another Partner, or already attributed to another marketing or referral source.
When more than one Partner claims the same guest or booking, Vegas Drivers Earn will determine attribution based on the available tracking and booking records. The earliest verifiable referral that directly resulted in the Eligible Booking will generally receive attribution.
Partners should report suspected tracking errors promptly. Claims concerning an uncredited referral should be submitted within 30 days after the scheduled experience date whenever reasonably possible so that booking and tracking records can be reviewed.
7. When Commission Is Earned
Commission is earned when:
- The referral is properly attributed to the Partner;
- The guest has paid for an Eligible Booking;
- The scheduled date of the applicable experience has passed;
- The payment has not been refunded, charged back, successfully disputed, determined to be fraudulent, duplicated, or otherwise reversed; and
- Any required tax or payment documentation has been provided.
Guest attendance is not required to earn Commission. If a properly attributed guest pays for an Eligible Booking but does not attend the scheduled experience, the Partner remains entitled to Commission so long as the booking remains paid and is not refunded, disputed, charged back, fraudulent, or otherwise reversed.
An unpaid reservation or incomplete booking does not earn Commission.
8. Commission Payments
Earned Commissions are typically processed within 24 hours after the scheduled experience date has passed and the Commission has been verified.
Payment may be delayed when reasonably necessary to investigate or resolve attendance verification, payment status, referral attribution, suspected fraud, refunds, disputes, chargebacks, missing tax documentation, incorrect payment information, or similar issues.
Vegas Drivers Earn may pay Commission sooner than the time stated above.
Partners are responsible for maintaining accurate payment and contact information.
9. Refunds, Chargebacks and Reversed Commission
No Commission is earned on a booking that is refunded, charged back, successfully disputed, fraudulent, or otherwise reversed.
A guest’s failure to attend the scheduled experience, by itself, does not cancel, reduce, or reverse an otherwise valid Commission.
If Commission was already paid before a booking was subsequently refunded, charged back, disputed, or determined to be fraudulent or ineligible, Vegas Drivers Earn may deduct the amount of that Commission from future amounts otherwise payable to the Partner.
If no future Commission is available for offset, Vegas Drivers Earn may request repayment of Commission that was paid in error or obtained through fraud or material misrepresentation.
10. Taxes and Tax Documentation
Partners are solely responsible for federal, state, local, and other taxes arising from Commission payments received through the Program.
Vegas Drivers Earn may require a completed Form W-9 or other reasonably required tax documentation before issuing Commission payments.
Vegas Drivers Earn may issue Form 1099-NEC or another applicable tax information return when required by applicable law.
Partners are responsible for providing accurate legal names, taxpayer identification information, addresses, and other information necessary for tax reporting.
Vegas Drivers Earn does not provide tax advice.
11. Independent Relationship
Participation in the Program does not create an employer-employee relationship, partnership, joint venture, franchise, agency, fiduciary relationship, or exclusive business relationship between the Partner and Vegas Drivers Earn.
Partners:
- Have no required work schedule;
- Have no minimum referral requirement;
- Are not required to participate on any particular day or at any particular time;
- Are free to decide whether, when, where, and how often to make referrals;
- Are not required to accept referral opportunities;
- Are not entitled to employee wages, benefits, paid time off, insurance, or other employee benefits;
- Are not granted authority to enter into contracts or incur obligations on behalf of Vegas Drivers Earn; and
- May participate in other lawful businesses, employment, affiliate programs, or referral programs, subject to their own contractual obligations.
Nothing in these Terms authorizes a Partner to represent that the Partner is an employee, officer, owner, agent, or legal representative of Vegas Drivers Earn.
12. No Affiliation With Transportation Companies
Vegas Drivers Earn is an independent referral program and is not affiliated with, sponsored by, endorsed by, or operated by Uber Technologies, Inc., Lyft, Inc., or any taxi company, limousine company, transportation-network company, hotel, resort, casino, or other third-party business merely because such company or category is referenced on VegasDriversEarn.com or in Program materials.
All third-party trademarks and names remain the property of their respective owners.
Partners are solely responsible for complying with the rules, policies, agreements, licensing requirements, and other obligations applicable to their employment, driving activities, or independent businesses.
13. Advertising and Representations
Partners must describe Vegas Drivers Earn, the Program, Commission opportunities, and available experiences accurately.
Partners may not:
- Make false, misleading, deceptive, or unsubstantiated claims;
- Guarantee admission to a venue unless expressly authorized;
- Guarantee specific venues, schedules, transportation, celebrities, entertainment, drink quantities, wait times, or other features unless expressly authorized;
- Misrepresent prices, discounts, inclusions, availability, Commission amounts, or booking conditions;
- Impersonate Vegas Drivers Earn, an experience operator, a venue, or another Partner;
- Represent themselves as an employee or authorized agent of Vegas Drivers Earn;
- Create fake reviews, fake testimonials, fabricated bookings, or false customer accounts;
- Use deceptive advertising techniques; or
- Make promises or commitments on behalf of Vegas Drivers Earn without written authorization.
Partners should direct guests to the applicable booking page for current pricing, schedules, inclusions, restrictions, and booking terms.
14. Commission Disclosure
When recommending or endorsing an Eligible Booking in circumstances where a guest may not reasonably understand that the Partner can receive compensation from the referral, the Partner must clearly disclose the financial relationship.
The disclosure must be presented in a manner reasonably noticeable to the prospective guest and should not be hidden or presented misleadingly.
15. Prohibited Marketing Practices
Partners may not promote the Program or Eligible Bookings through unlawful spam, deceptive messages, fraudulent accounts, unauthorized automated messages, illegal robocalls or robotexts, purchased contact lists used unlawfully, or other marketing methods that violate applicable law.
Partners are solely responsible for obtaining any legally required consent before sending marketing calls, text messages, emails, or other communications.
Partners must honor applicable unsubscribe, opt-out, and do-not-contact requests.
16. Referral Links and Codes
Referral Links and Codes are provided solely for legitimate participation in the Program.
Partners may not:
- Alter or manipulate tracking systems;
- Create unauthorized referral codes;
- Sell or transfer an assigned Referral Link or Code;
- Intentionally overwrite another Partner’s attribution;
- Attach their Referral Link or Code to a booking they did not originate;
- Use automated or deceptive means to generate attribution; or
- Attempt to obtain Commission through artificial, fabricated, or fraudulent bookings.
Referral Links and Codes remain subject to modification or replacement by Vegas Drivers Earn.
17. Self-Referrals and Program Abuse
Partners may not create self-referrals or arrange transactions primarily for the purpose of generating Commission unless Vegas Drivers Earn expressly approves the transaction in writing.
Vegas Drivers Earn may withhold, cancel, reverse, or deny Commission associated with:
- Fraud;
- Fabricated guests;
- Duplicate bookings;
- Manipulated tracking;
- Unauthorized discounts;
- Chargeback schemes;
- False identities;
- Self-referrals;
- Collusion;
- Misrepresentation; or
- Other material abuse of the Program.
Vegas Drivers Earn may temporarily suspend Commission payments while reasonably investigating suspected Program abuse.
18. Guest Discounts
Some Referral Links or Codes may provide guests with a discount.
The amount of a guest discount and the corresponding Partner Commission may vary depending on the specific promotion.
Partners may advertise only discounts expressly authorized by Vegas Drivers Earn.
Partners may not create, alter, promise, or advertise unauthorized discounts.
19. Booking and Experience Conditions
Nightlife experiences, transportation arrangements, venue admission, schedules, participating venues, dress codes, identification requirements, age requirements, availability, meeting locations, operating procedures, and other experience details may be subject to separate booking terms.
Venues, transportation arrangements, schedules, and itineraries may change because of operational requirements or circumstances outside the reasonable control of Vegas Drivers Earn or the applicable experience operator.
A referral Partner does not have authority to waive or modify booking requirements.
Guests remain responsible for satisfying the applicable booking and participation requirements.
20. No Guarantee of Earnings
Vegas Drivers Earn does not guarantee that any Partner will generate referrals or earn any particular amount of Commission.
Statements such as “1 Guest = $50,” “20 Guests = $1,000,” or similar examples demonstrate the applicable Commission calculation and do not guarantee that a Partner will refer or generate that number of Qualifying Guests.
Actual earnings depend on the number of properly attributed referrals that become paid, eligible bookings and remain valid under these Terms.
21. Program Changes
Vegas Drivers Earn may modify the Program, eligible products, Commission rates, tracking procedures, payment methods, promotional rules, or other Program features.
Changes to Commission rates will apply prospectively and will not reduce the Commission rate applicable to an Eligible Booking that was already confirmed and properly attributed before the change.
Vegas Drivers Earn may update these Terms from time to time. The updated Terms will display a revised “Last Updated” date.
Material changes may require Partners to affirmatively accept updated Terms before continuing to participate.
22. Suspension and Termination
A Partner may stop participating in the Program at any time.
Vegas Drivers Earn may suspend or terminate a Partner for fraud, abuse, misleading advertising, misuse of referral systems, material violation of these Terms, unlawful conduct, conduct materially harmful to guests or participating businesses, or other material Program violations.
Vegas Drivers Earn may also discontinue the Program generally upon reasonable notice when practicable.
Termination does not eliminate Commission on an otherwise Qualifying Guest or Qualifying Private Group Booking that was confirmed and properly attributed to the Partner before termination, provided the applicable booking is subsequently completed and is not subject to refund, chargeback, fraud, dispute, cancellation, or another disqualifying condition.
Commission associated with fraud, abuse, or a material violation of these Terms may be withheld or canceled.
23. Intellectual Property
Vegas Drivers Earn names, logos, graphics, website content, advertising materials, photographs, designs, referral materials, and other brand assets are owned by or licensed to Vegas Drivers Earn and are protected by applicable intellectual-property laws.
Partners may use only Program marketing materials that Vegas Drivers Earn provides or expressly authorizes for Partner use.
Partners may not materially alter approved promotional materials in a manner that creates false, misleading, deceptive, or unauthorized claims.
Permission to use Program materials terminates when participation in the Program ends.
24. Website Use
Users and Partners may not:
- Attempt unauthorized access to VegasDriversEarn.com or related systems;
- Introduce malware or malicious code;
- Interfere with website functionality;
- Circumvent security or referral-tracking systems;
- Harvest personal information unlawfully;
- Use automated systems in a manner that materially burdens or disrupts the website; or
- Use the website for fraudulent or unlawful activity.
25. Privacy
Information collected through VegasDriversEarn.com and the Program is handled in accordance with the Vegas Drivers Earn Privacy Policy.
By participating in the Program, Partners acknowledge that referral, booking, contact, payment, tax, and tracking information may be processed as reasonably necessary to administer the Program, verify Commission, prevent fraud, comply with legal obligations, and provide Program support.
26. Third-Party Services
Vegas Drivers Earn may use third-party booking platforms, payment processors, communications providers, hosting providers, tracking technologies, and experience operators.
Vegas Drivers Earn is not responsible for temporary outages, delays, errors, or failures caused solely by independent third-party systems or circumstances outside its reasonable control.
Nothing in this section excuses Vegas Drivers Earn from paying Commission that has otherwise been properly earned under these Terms.
27. Disclaimer of Warranties
To the fullest extent permitted by applicable law, VegasDriversEarn.com and the Program are provided on an “as is” and “as available” basis.
Vegas Drivers Earn does not warrant that the website, tracking technology, Program, or third-party systems will operate without interruption or error.
This section does not eliminate obligations expressly undertaken by Vegas Drivers Earn under these Terms.
28. Limitation of Liability
To the fullest extent permitted by applicable law, Vegas Drivers Earn and its owners, affiliates, officers, employees, contractors, and participating operators will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Program or use of VegasDriversEarn.com.
Except for Commission properly earned and payable under these Terms, and except for liability that cannot lawfully be limited or excluded, the aggregate liability of Vegas Drivers Earn arising from or relating to the Program will not exceed the greater of:
- The total Commission paid or payable to the Partner during the six months immediately preceding the event giving rise to the claim; or
- $500.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
29. Indemnification
To the fullest extent permitted by law, a Partner agrees to indemnify and hold harmless Vegas Drivers Earn and its owners, affiliates, officers, employees, and contractors from third-party claims, damages, liabilities, penalties, and reasonable costs arising from or caused by the Partner’s:
- Fraud or intentional misconduct;
- Material breach of these Terms;
- False or misleading representations;
- Unauthorized advertising or promises;
- Violation of applicable law;
- Infringement of third-party intellectual-property rights; or
- Unauthorized use of personal information or marketing communications.
This obligation applies only to the extent the applicable claim or loss was caused by the Partner’s conduct.
30. Events Beyond Reasonable Control
Neither party will be responsible for a failure or delay caused by circumstances beyond that party’s reasonable control, including severe weather, natural disasters, venue closures, transportation disruptions, utility or communications failures, government orders, emergencies, labor disruptions, widespread technology failures, or similar events.
This section does not eliminate an obligation to account for or pay Commission already properly earned before the applicable event.
31. Governing Law and Venue
These Terms and any dispute arising from or relating to the Program or VegasDriversEarn.com will be governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
Subject to applicable federal jurisdiction and any jurisdiction that cannot legally be waived, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Clark County, Nevada.
Before initiating litigation, a party should provide written notice describing the dispute and allow the other party at least 30 days to attempt in good faith to resolve the matter informally, except when immediate injunctive or similar relief is reasonably necessary.
32. Electronic Communications and Acceptance
Partners agree that Program applications, agreements, notices, acknowledgments, updates, payment records, and other Program communications may be provided electronically.
Electronic acceptance of these Terms, including acceptance through a website checkbox or similar electronic process, is intended to constitute acceptance of these Terms.
Partners are responsible for maintaining a current email address and other contact information.
33. Assignment
A Partner’s participation in the Program and assigned Referral Link or Code are personal to that Partner and may not be sold, assigned, or transferred without written approval from Vegas Drivers Earn.
Vegas Drivers Earn may assign these Terms in connection with a merger, acquisition, sale of substantially all relevant assets, corporate restructuring, or transfer of the Program to an affiliated or successor business.
34. Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary, and the remaining provisions will remain in effect.
35. Waiver
A failure by Vegas Drivers Earn to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or any other provision later.
36. Entire Agreement
These Terms, together with the Privacy Policy and any written Program terms expressly incorporated into them, constitute the agreement between the Partner and Vegas Drivers Earn concerning participation in the Program.
If Vegas Drivers Earn and a Partner enter into a separate written agreement that expressly modifies a provision of these Terms, the expressly modified provision of the separate written agreement will control.

Section headings are provided for convenience and do not limit or alter the meaning of these Terms.
